تأجيل إعدام ريحانة جباري إحدى الناجيات من اعتداء جنسي ونقلها إلى سجن غرب العاصمة

يتعين على السلطات الإيرانية وقف إعدام إحدى الناجيات من اعتداء جنسي مزعوم

قالت منظمة العفو الدولية اليوم إن السلطات الإيرانية أكدت أنه سيتم تنفيذ حكم الإعدام شنقاً بحق امرأة كانت قد أُدينت بقتل رجل، قالت إنه حاول الاعتداء عليها جنسياً، صباح يوم غد في سجن يقع غرب العاصمة طهران. 

ففي عام 2009 حُكم على ريحانة جباري بالإعدام إثر تحقيقات ومحاكمة شابتْها مثالب كبيرة، ولم تفحص جميع الأدلة. 

وقالت حسيبة الحاج صحراوي، نائبة مدير برنامج الشرق الأوسط وشمال أفريقيا في منظمة العفو الدولية: "إنه ينبغي عدم تنفيذ هذا الإعدام الفظيع، وخصوصاً مع وجود شكوك جدية في ظروف حادثة القتل." 

"وبدلاً من الاستمرار في إعدام الأشخاص، يتعين على السلطات الإيرانية إصلاح النظام القضائي، الذي يستند على نحو خطير إلى إجراءات لا تفي بالقوانين والمعايير الدولية للمحاكمات العادلة."

وبموجب المعايير الدولية لحقوق الإنسان، من حق الأشخاص الذين يُتهمون بارتكاب جرائم يُعاقَب عليها بالإعدام تحقيق المراعاة الصارمة لجميع ضمانات المحاكمة العادلة."

وكان قد قُبض على ريحانة جباري، البالغة من العمر 26  عاماً، في عام 2007 بتهمة قتل مرتضى عبداللالي سربندي، وهو موظف سابق في وزارة الاستخبارات الإيرانية. وقد وُضعت في الحبس الانفرادي لمدة شهرين، لم يُسمح لها خلالها بتوكيل محام أو الاتصال بعائلتها. وفي عام 2009 حكمت محكمة جنائية في طهران على ريحانة جباري بالإعدام بموجب أحكام "القصاص".

وقد فهمت منظمة العفو الدولية أنه مع أن ريحانة جباري اعترفت بأنها طعنت الرجل من الخلف مرة واحدة، فقد قالت إن رجلاً آخر كان موجوداً في المنـزل كذلك هو الذي قتل مرتضى سربندي. ولكن لم يجر تحقيق سليم في ادعائها مطلقاً.

وأضافت حسيبة الحاج صحراوي تقول: "إن السلطات الإيرانية يجب أن توقف تنفيذ الإعدام بحق ريحانة فوراً. إذ أن عدم السماح بحضور محام خلال التحقيق معها يعتبر أمراً غير مقبول، وأن عدم التحقيق في ادعاء وجود رجل آخر في المنـزل يترك العديد من الأسئلة بلا إجابات."

وقالت والدة ريحانة في تعليق لها على فيس بوك اليوم إن سلطات سجن إيفين أبلغتها بأن تذهب إلى السجن "لتسلُّم جثمان" ابنتها غداً.

إن منظمة العفو الدولية تعارض عقوبة الإعدام في جميع الظروف وبلا استثناء، بغض النظر عن طبيعة ملابسات الجريمة؛ أو الذنب أو البراءة أو سمات الشخص؛ أو الأسلوب الذي تستخدمه الدولة لتنفيذ الإعدام، ذلك لأن عقوبة الإعدام تشكل انتهاكاً للحق في الحياة المنصوص عليه في الإعلان العالمي لحقوق الإنسان، وتُعتبر العقوبة النهائية القاسية واللاإنسانية والمهينة

خلفية

في 14 سبتمبر/أيلول 2014، ورد أن السلطات القضائية ضغطت على ريحانة جباري لحملها على إبعاد محاميها محمد علي جداري فروغي عن قضيتها وتوكيل محام لا يتمتع بالخبرة بديلاً له. ويبدو أن ذلك الأمر جرى كمحاولة واضحة لقطع الطريق على الجهود الرامية لضمان إجراء تحقيق في ادعاء وجود رجل آخر في المنـزل.

وفهمتْ منظمة العفو الدولية أن الطلبات المتكررة التي قدمها المحامي محمد علي جداري فروغي للقاء موكلته والاطلاع على ملف المحكمة، قبل إقصائه عن القضية، قد رُفضت.
